LAWS OF MARYLAND 1973
MARYLAND, Sct.:
At a Session of the General Assembly of Maryland, begun and held in the City of
Annapolis on the Tenth Day of January, 1973, and Ending on the Ninth Day
of April, 1973. Marvin Mandel being Governor of the State, the following
Laws were enacted, to wit:
CHAPTER 1
(House Bill 1457 of 1972)
AN ACT to repeal and re-enact, with amendments, subsection 245(c) of Article 41
of the Annotated Code of Maryland (1971 Replacement Volume), title
"Governor-Executive and Administrative Departments," subtitle
"Administrative Procedure Act," to prohibit the adoption or amendment of
rules which increase expenditures beyond budgetary allowance by an agency
without the approval of the General Assembly or its designee.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That subsection 245(c) of Article 41 of the Annotated Code of
Maryland (1971 Replacement volume), title "Governor-Executive and
Administrative Departments," subtitle "Administrative Procedure Act," be and it
is hereby repealed and re-enacted, with amendments, to read as follows:
245.
(c) Prior to the adoption of any rule authorized by law, or the amendment or
repeal thereof, the adopting agency shall publish or otherwise circulate notice of its
intended action, and afford interested persons opportunity to submit data or views
orally or in writing. NO AGENCY SHALL ADOPT OR AMEND ANY RULE
OR ADMINISTRATIVE ACT WHICH INCREASES THE AGENCY'S
EXPENDITURES BEYOND BUDGETARY LIMITATIONS WITHOUT THE
EXPRESS APPROVAL OF THE GENERAL ASSEMBLY OR ITS
DESIGNEE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1972.
